Smaller businesses, particularly recent start-ups and home-based enterprises, face difficult choices when it comes to allocating limited human and financial resources among competing priorities.
Because smaller businesses (generally with fewer than 15 employees) are exempt from coverage under Title VII and some other federal civil rights laws, some business owners place a low priority on educating themselves and their employees about discriminatory harassment and necessary steps to prevent it from occurring in the workplace. These owners accept the risk that their company may be exposed to legal liability for discriminatory harassment under state law or that the company will face adverse publicity arising out of a claim of harassment. For these owners, the magnitude of these risks seems to be outweighed by the cost of addressing them particularly in light of other pressing business objectives.
